SB 1505: Improves Compassionate Use Program, Limits THC

Senate Bill 1505 makes changes to the Texas Compassionate Use Program. The bill limits patient access to THC, but legalizes the use of cannabis inhalation and vaping. 


SB 1505 allows the Department of Public Safety (DPS) to issue licenses to a maximum of six dispensing organizations, which must be located strategically to ensure adequate patient access. The bill also allows dispensing organizations to open approved satellite locations.  


Status: SB 1505 has passed out of the State Affairs Committee and will soon be voted on by the full Texas Senate.

    Policy Overview: Senate Bill 1505

    Patient Impact


    • Prescription Limits: Patients would only be prescribed a 90-day supply of medication. Total THC would be limited to 5mg per dose and 300mg per package.
    • Product Availability: In addition to oils and edibles (currently legal), patients would have access to products like transdermal patches, suppositories, inhalers, and vape devices.

    Business Impact


    • Satellite Locations: With approval from DPS, licensed dispensing organizations could open one or more satellite locations in addition to their primary location. 
    • Limited Licenses: DPS would only be allowed to issue licenses to six dispensing organizations.
    • Regional Access: New or renewed licenses would be issued strategically to ensure adequate patient access in each of Texas’ 11 public health regions.
    • Active Licenses: Dispensing organizations would be required to begin operations within 24 months of receiving their license and must maintain production in order to retain their license. 


    If passed, SB 1505 would go into effect on September 1, 2025 and all necessary rules must be adopted by October 1, 2025.
