Vicente’s Daniel Molina published a briefing with more info on the recent schedule change. This change is significant because there are now criminal penalties in place for the possession of synthesized THC like Delta 8 or Delta 10 THC.

“Texas synthetic cannabinoids are once again Schedule I controlled substances. In the July 10, 2026 edition of the Texas Register, the Texas Department of State Health Services (DSHS) published a notice reinstating the 2021 modifications to the definitions of “Tetrahydrocannabinols” and “Marihuana extract” in Schedule I of the Texas Schedules of Controlled Substances.”
