Between legislative sessions (known as the “interim”), committees of lawmakers are tasked with “interim charges,” which call on them to study various areas of policy and make recommendations. Last year, Lt. Gov. Patrick tasked the Senate State Affairs Committee with two cannabis-related interim charges:

  • Banning Delta 8 and 9: “Examine the sale of intoxicating hemp products in Texas. Make recommendations to further regulate the sale of these products, and suggest legislation to stop retailers who market these products to children.”
  • Beverages with THC: Evaluate Texas laws and regulations concerning THC beverage manufacturing and delivery. Report on the current regulations and safeguards Texas may or may not have in place for drinks with any amount of THC. Recommend legislation to protect Texas consumers.”

The committee hosted hearings on these two cannabis-related charges, with witnesses testifying in support and in opposition to shutting down Texas’ blooming consumable hemp industry. Learn more and watch the hearings here.

Now, the State Affairs Committee has published its Interim Report, which includes an overview of the issue as they see it, a recap of select witness testimony, and policy recommendations.

Recommendation for Banning Delta 8 and 9: As a result of this loophole, retailers in Texas are openly selling intoxicating marijuana. The Legislature should close the legal loophole and ban intoxicating hemp products in the state.

The Legislature should also ensure that children are protected from exposure and that the state sanctioned medical marijuana program is not undercut. (Starts on page 42.)

Recommendation for THC Beverages: The Committee recommends that drinks containing THC, except for those that are regulated by the Texas Compassionate Use Program, should be banned in agreement with the recommendations listed in Charge No. 5. (Starts on page 68.)
