An industry lawsuit against DSHS is still ongoing. The suit challenges rules adopted by DSHS at the direction of Governor Abbott.
The case brought by the Texas Hemp Business Council and other retailers challenges the “Total THC” testing standard that folds THCA into the delta-9 calculation, plus significant licensing fee hikes.
The trial was initially set to start July 27th, but a recent update from THBC and their attorneys says it was delayed and the case could stretch into 2027.
